"You" and "We"

"You" (also "you") means the person or organization using the site and/or paying for and playing the game.

You may purchase the game for your own use, but you may not purchase the game and share access with any other person or organization.

"We" (also "we", "Us", "us", "Our", "our") refers to Rock Your Genius, LLC, which owns all rights to the site and the game.

Privacy policy

By using the site, you also agree to our privacy policy.

The game

The INFJ writing game ("the game") currently includes access to materials, resources, and a private players-only community meant to assist you in your efforts as an INFJ nonfiction writer (mostly for self-help, personal development, motivational, and inspirational nonfiction).

Intellectual property

The site and the game include intellectual property owned by Rock Your Genius, LLC., which is made available to you as part of playing the game. This material shall remain the sole property of Rock Your Genius, LLC.

No license to sell or distribute our materials is granted or implied. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce, perform, or in any way exploit in any format whatsoever any of the site or the game content or intellectual property, in whole or in part, without our prior written consent.

This includes, but is not limited to, sharing material with others who have not paid for the game and/or posting or publishing any of the material online or offline.

We reserve the right to immediately remove you from the game, without refund, if you are caught violating this intellectual property policy.

Payment

The purchase price for the game is currently $299US per round (if played on a per-round basis) or $1188US per year (if played on an annual basis, which includes 8 total rounds of play).

All purchases must be made by credit card using Stripe’s payment processing service, and by making this purchase, you agree to Stripe’s user agreement.

In the event that your subscription payment fails, you will lose access to the game until the balance is paid in full.

Community guidelines

We have a strict no-a**hole policy. Any type of a**holery will not be tolerated. This includes, but is not limited to:

• Doing anything unlawful,
• Infringing on the rights of others (including copyrights),
• Stalking, threatening, or harassing other players,
• Spamming or using the site or the game to engage in commercial activities not related to the game (at our discretion),
• Accessing the material of the game, the site, or other players for market research purposes or to create competing businesses and/or materials,
• Impersonating another or otherwise misrepresenting yourself in the game or community,
• Interfering with or attempting to interrupt the site or the game (including, but not limited to, activities like hacking, scraping, data mining, imposing an unreasonable or disproportionately large load on our resources, etc.).

As a community member and player of the game, we expect that you will notify us of any of these activities by other members, should you become aware of them.

We reserve the right, at our sole and absolute discretion, to deny you access to the site and/or the game without notice (and without refund) and to remove any content that does not adhere to these guidelines.

Cancellations and refunds

Payment for the game is made in advance.

If you cancel before the end of your pre-paid time period (round, month, year, etc.), you will retain access to the game and its materials, sites, apps, and resources until the end of the paid-up term, at which point you will be removed from the game (and its materials, sites, apps, and resources) and not charged again until (if and/or when) you sign up to play again.

Refunds will only be processed within seven (7) days of purchase and then only up to the first day of game play for your pre-paid time period (round, month, year, etc.). There are no refunds after game play begins. There are no refunds or prorations should you elect not to play after your pre-paid game has begun.

Changes to pricing and the game

We reserve the right to make changes to the game pricing or content at any time. If we make changes to the game content during game play, we will make every reasonable attempt to notify you as soon as we are aware of those changes, as some changes may be outside our control or knowledge until just before we notify you.

Rock Your Genius, LLC shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the game.

Updates to these terms

We may update these terms from time to time. Such updates are effective immediately. Any use of the site and/or the game signifies your acceptance and agreement to the updated terms. We will post the "Last update" date at the top of the Terms page.

Disputes and disagreements

All disputes or disagreements related to these terms shall be resolved in a court located in Porter County, Indiana. By purchasing and playing the game, you consent and submit to this jurisdiction. This agreement shall be governed by Indiana law.

By purchasing and playing the game, you agree that if there’s a dispute or disagreement, you may only bring a claim on behalf of yourself (no class action lawsuits), and you also agree that the maximum amount you can collect from a dispute or disagreement is a refund in the amount of your total payment for the game.

If a court of competent jurisdiction finds any part of this agreement to be invalid, the remaining terms shall continue in full force and effect.
